FORMATION OF AN ADMINISTRATIVE AND LEGAL MECHANISM FOR QUALITY CONTROL OF POLICE SERVICES UNDER SPECIAL LEGAL REGIME

Abstract

The article examines the theoretical and legal principles of forming an administrative-legal mechanism for controlling the quality of police services in Ukraine, taking into account international experience and the specifics of a special legal regime. The relevance of the issue in the context of the transformation of the model of police activity from punitive-security to public-service, when the quality of services becomes the main indicator of the effectiveness and legitimacy of law enforcement agencies, is substantiated. The concept of Total Service Quality is analyzed, which involves assessing the effectiveness of the police not only by quantitative indicators, but also by the level of citizen satisfaction. The international experience of the USA, Canada, Australia and New Zealand is summarized. The Canadian standards of police activity of Nova Scotia with a multi-level control system during emergencies, the American practice of monitoring through callbacks, the New Zealand model of state reporting are considered. Common features are identified: normative certainty of standards, combination of internal and external control, public involvement, cyclicality of inspections and orientation towards sustainable quality in crisis conditions. The transformation of the content of police services under martial law in Ukraine is substantiated: evacuation of the population, delivery of humanitarian aid, elimination of the consequences of shelling, documentation of war crimes. It is proven that quality control is modified, transforming from a management tool into a mechanism for maintaining the legitimacy of public authorities. The author’s concept of a flexible control mechanism consisting of four elements is proposed: internal level (operational audit through the “Police Service Quality Map”); external level (public monitoring through the QR-system of blitz-surveying); digital trust metrics; public reporting and staff incentives (quarterly publication of ratings with a system of incentives). The author’s definition of quality control of police services under a special legal regime is formulated as a system of internal and external measures of observation, evaluation and correction of police activities regulated by administrative and legal norms, aimed at ensuring the stability of public safety, legality and trust of citizens in situations of limited availability of standard management procedures. The expediency of legislative consolidation of the mechanism by supplementing the Law of Ukraine “On the National Police” with a separate section “Quality Control of Police Services” with the definition of a system of quality indicators, an audit procedure, requirements for the publicity of reporting and mechanisms for encouraging personnel is substantiated.
