DEVICES FOR FORCED OPENING OF VEHICLES AND LEGAL GROUNDS FOR THEIR APPLICATION

Abstract

Today, police patrol police units of Ukraine in the performance of their duties in the field of traffic control and supervision as police coercive measures may use special means, which are contained in the Law of Ukraine "On National Police". However, there are many cases when other technical devices, which are currently not available in the National Police of Ukraine, are needed to protect human life and health, as well as to stop or counteract certain offenses, including the use of vehicles. The authors of the article analyzed a number of devices, which provide the possibility of breaking the side window of the car, however, only five devices were studied in more detail (their configuration, technical capabilities and aspects of the technological process). Methods of forcible opening of the vehicle with the help of a telescopic baton, a throwing knife with a built-in cullet, a tactical handle - a kubotan and an emergency hammer demonstrated a number of shortcomings, such as: maximum scattering of glass; uncontrolled impact force; the possibility of injuring people inside the car; the risk of injuring a police officer using this device; the possibility of injuring persons close to the police officer. The "Wincrusher" prefabricated device deserves special attention, because using this device, you can quickly, efficiently and safely forcibly open the vehicle by destroying any of the side windows of the car. The device "Wincrusher" consists of two separate elements - a fixing frame with vacuum suction cups and a shock inertial hammer. However, it should be remembered that when using the device, basic safety measures should be observed to preserve the health of both the person inside the vehicle and the employee of the National Police of Ukraine. In order to consolidate the legal framework for the use of "Wincrusher" by police units at the state level, it is necessary to amend the Law of Ukraine "On National Police" of July 2, 2013 № 580-VIII, in particular Article 42 "Police coercive measures" and Article 45 "Application of special means", because this normative legal act approves a list, order and rules of use by the police of special means.
