THE ROLE OF VIDEO MONITORING TECHNOLOGIES IN LAW ENFORCEMENT ACTIVITIES OF THE GERMAN POLICE

Abstract

The article is devoted to the study of the possibilities of using intelligent video monitoring technologies in the activities of law enforcement agencies of Ukraine. The relevance of implementing video monitoring systems in law enforcement activities of Ukraine is considered, taking into account the experience of high-tech countries. The history of implementing video surveillance systems in the activities of the German police, the features of the legislation in this area are analyzed. Despite significant scientific and technological progress and the novelty of video surveillance technologies, despite the fact that the first closed-circuit video surveillance system equipped with cameras with electronic scanning was installed in Germany, the pace of development of the public camera system in the country in the 1980s and 1990s significantly lagged behind the pace of development in other European countries, in particular in the United Kingdom. In Germany, the Constitutional Court stated back in 1983 that “for a democratic society and the autonomy of citizens, it is fundamentally important to be aware that they are being monitored, as well as why and by whom.” Therefore, in Germany, video surveillance is always carried out with permission, otherwise judicial practice considers it a violation of the rights of the individual. For this reason, most federal states have introduced legislation that allows the police to conduct surveillance and recording in various (broadly defined) geographical areas where factual indications justify the assumption that offenses will be committed in this type of place or on objects of this type. The need for the creation of comprehensive public security systems is substantiated, the role of digital transformation and international standards in the formation of a modern concept of security is determined. The importance of harmonizing national legislation with European norms and integrating innovative technologies into the activities of law enforcement agencies is emphasized. Based on the analysis of the axiological aspects of the implementation of information technologies and security systems in law enforcement activities in Germany, examples of implementation, and the results of specialized scientific research in this area, it is concluded that the implementation of comprehensive security monitoring systems will significantly increase the effectiveness of criminal offense prevention, ensuring more reliable protection of citizens and society as a whole. There is a need to implement the General Data Protection Regulation (GDPR) into Ukrainian legislation.
