СRIMINAL CHARACTERISTICS OF IMPROPER PERFORMANCE OF PROFESSIONAL DUTIES BY A MEDICAL OR PHARMACEUTICAL WORKER

Abstract

The article is devoted to the study of the theoretical provisions of the forensic characterization as a component of the investigation methodology and the formation of a forensic characterization of improper performance of professional duties by a medical or pharmaceutical worker, which contributes to the identification of typical signs of the specified criminal offenses. The purpose of the study is to study scientific concepts and approaches to the concept and meaning of the forensic characterization; to clarify and reveal the signs of improper performance of professional duties by a medical or pharmaceutical worker; to provide a forensic characterization of improper performance of professional duties by a medical or pharmaceutical worker. In accordance with the set goal, it is determined that the forensic characterization is a component of the investigation methodology, which combines summarized data on the signs, characteristics and properties of individual criminal offenses, which is an information basis, a set of generalized information formed on the basis of a combination of practical experience and modern scientific research. It is emphasized that the forensic characterization of improper performance of professional duties by a medical or pharmaceutical worker is formed taking into account their specific features, which are due to the complexity of collecting and examining evidence, ordering forensic examinations; the need to bring to criminal liability and prove the guilt of a special subject – a medical or pharmaceutical worker; proving the cause-and-effect relationship between improper performance of professional duties by a medical or pharmaceutical worker and the occurrence of serious consequences. It is established that the forensic characterization of improper performance of professional duties by a medical or pharmaceutical worker covers typical features inherent in the specified criminal offenses and provides a characteristic of the following elements: the identity of the offender, the method of committing the criminal offense, the identity of the victim, the situation, typical traces and consequences of the criminal offense.
