INTERNATIONAL HUMAN RIGHTS STANDARDS IN POLICE ACTIVITY: CONSTITUTIONAL AND DEONTOLOGICAL DIMENSIONS

The article is devoted to a comprehensive theoretical and legal analysis of international human rights standards as the normative foundation of police activity in their interrelation with constitutional guarantees and professional-ethical principles of law enforcement service. The legal nature of international standards, their universal and regional character, as well as the mechanisms of their implementation into the national legal system are examined. Particular attention is paid to the constitutional and legal foundations of police activity, which determine the limits of the exercise of public authority and ensure the humanistic orientation of law enforcement. It is shown that constitutional rights and freedoms have direct effect and serve as the primary criterion for assessing the legality of law enforcement actions. It is substantiated that police activity must comply not only with national legislation but also with the state’s international obligations, which ensures the harmonization of law-enforcement practice with international legal standards. The significance of the case law of international judicial bodies as a factor in shaping standards of law enforcement activity is analyzed. It is argued that decisions of international judicial institutions perform not only a supervisory but also a modernizing function, influencing the reform of law enforcement systems and the improvement of national legislation. The deontological dimension of police activity is revealed, the structure of police deontology is defined, and the role of ethical principles in ensuring human rights is clarified. It is demonstrated that professional ethics acts as an internal regulator of police conduct and complements legal norms, forming a comprehensive mechanism for human rights protection. The concept of a triadic model for ensuring human rights is proposed, combining international standards, constitutional guarantees, and professional-ethical foundations of police activity. It is concluded that the effectiveness of police activity in the field of human rights depends on the coordinated functioning of normative, institutional, and value-based components of legal regulation, while the integration of legal and moral principles contributes to the formation of a modern human-rights-oriented model of law enforcement.
