ROAD TRAFFIC PARTICIPANTS LEAVING THE VENUE OF A ROAD ACCIDENT («HIT-AND-RUN»): ANALYSIS OF THE STATE OF THE PROBLEM IN UKRAINE AND ABROAD

Abstract

This article is devoted to the actualization of the problem and clarification of the status of such offenses as leaving the scene of a road accident by its participants. It is assumed that the status and characteristics of this negative socio-legal phenomenon in our country today do not yet have the proper level of formation. The purpose of the study is to clarify the status and trends (using the example of an analysis of foreign and domestic experience) and to substantiate the signifi- cance of statistical and analytical data for understanding the problems of such a phenomenon as leaving the scene of an accident by participants in a road accident. An analysis of foreign experience (using the example of the USA and Great Britain) indicates that in other countries of the world, leaving the scene of an accident by road traffic participants, as well as for Ukraine, is a widespread problematic phenomenon in the field of road safety and law enforcement. At the same time, complete statistics on such incidents («failure to stop» or «Hit-and-Run») are often unavailable for public access and re- quire special requests to the Ministry of Justice or law enforcement agencies. Regarding Ukraine, it has been established that publicly available official sources of statistics in the field of road safety and law enforcement activities do not provide aggregated and detailed information on cases of leaving the scene of road accidents as a separate category. This signifi- cantly complicates the formation of a clear picture of the state, scale and dynamics of this problem in our country both in previous years and at the moment. Based on the analysis of judicial statistics on the consideration of cases of administrative offenses under Articles 122-4 and 124 of the Code of Ukraine on Administrative Offenses for the period from 2020 to 2024, an alarming trend was identified: since the beginning of the full-scale war in Ukraine, the number of cases of leaving the scene of traffic accidents with material damage (without victims) registered by the police has been gradually increasing.
