TASKS OF FORENSIC PSYCHOLOGICAL EXAMINATION WITHIN CRIMINAL PROCEEDINGS AGAINST MINORS BY SUBJECT MATTER

Abstract

It is noted that the timely and justified application of special psychological knowledge makes it possible to clarify many facts necessary to establish the truth in certain categories of criminal proceedings, since the use of this knowledge in legal activities is, first of all, of a significant applied nature. Emphasis is placed on resolving issues within the framework of proceedings concerning minors, which require not only the professional and life experience of an investigator or judge, but also a qualified expert opinion of a specialist in the field of psychology. Forensic psychological examination of minors is carried out in criminal proceedings in relation to persons who have a certain procedural status. Forensic psychological examination is assigned after the initiation of a criminal case, during the pre-trial or judicial investigation. Forensic psychological examination of minors is carried out on the basis of a resolution of the investigator or a court resolution.The resolution (resolution) must set out the plot of the case, indicate the reasons for ordering the examination, who is entrusted with conducting the examination, and what issues are submitted for its resolution. Psychological examination establishes those features of mental activity and their manifestations in a person's behavior that have legal significance and cause certain legal consequences. The article deals with the tasks of forensic and psychological examination of juveniles by subject species in the situation of the constantly increasing need of bodies of pre-trial investigation in the involvement of special psychological knowledge. It is noted that with the help of forensic psychological examination of the ability of a minor victim in criminal proceedings against crimes against sexual immunity, data can be obtained that allow you to understand and correctly evaluate the features of mental activity and behavioral manifestations of persons relevant to conclusions. Forensic psychological examination of the ability of a minor (suspect, accused) with a lag in mental development, not related to mental disorder, to fully realize the actual nature and importance of their actions and fully manage them to determine that the formation of children in unsatisfactory, personal violations.
